Application of the terms and conditions of sale : The conditions of sale set out below on this webpage shall apply to all contracts for the supply of goods made with the seller and the person purchasing the goods and shall not be deemed or construed to be modified, rescinded or waived in whole or in part whatever the clauses on the documents of the buyer are except by written amendment by both parties.
The act of making an order implies complete adhesion, without reserve, to these Terms and Conditions by the purchaser, with the exclusion of all other documents.

Applicable legislation and Appropriate Jurisdiction : A customer order is a contract subjected to French law. Within the context of interpretation and execution of this contract all litigation will be brought before the residential jurisdiction of the defender at Toulouse (31)/ applicable jurisdiction as stated in the directives and the rules of the European Union (in particular The Brussels Convention 27th September 1968).

Order : Information provided with the product is carefully looked over. However, La Cave Spirituelle cannot be held responsible if an unintentional mistake has been made in the information published on this site. Any order is considered definitive. However, you have the right to amend the order by sending a message to La Cave Spirituelle within 7 days from the day you sent us your order. Once this delay period has passed, the order cannot be amended as it has already been despatched.

Products : Photos are not contractual. We despatch according to the order of arrival of the orders. Although we continually monitor inventory to ensure product availability, there are times when products may be out of stock. If that occurs, La Cave Spirituelle suggests comparable substitutions but you are free to refuse this offer. In this case, the sale of this product is cancelled and the purchaser will benefit from a credit.

Prices : All prices are in Euros (€). Products are sold according to the prices indicated on the site the day of the order. In the event of the modification of the vintage or of the price by our suppliers, prices may vary at any moment and without notification.
As soon as your order form has been confirmed on the site, the price of ordered goods is payable in full to La Cave Spirituelle.

Payment methods : Payment is made by cheque to La Cave Spirituelle or by credit card in Euros (€) thanks to the SP Plus System of the bank Caisse d'Epargne. Your bank account is debited in the currency of your country at the exchange rate set by your bank.
The order will be sent upon receipt of your payment.

Deed of title : In accordance to French law N° 80 336 dated 01 May 1980, relating to deed of title, goods remain the property of La Cave Spirituelle until payment has been received in full.

Delivery : We do our best to shorten our delivery time. However, dates given for delivery are stated in good faith but are not to be treated as a condition of the sale. No claim shall be made by the buyer on account of late delivery however caused. Late delivery shall not constitute a breach of this contract by the seller, and the buyer shall not be entitled to cancel the contract because of late delivery and he shall not be able to ask for any penalty or compensation in the event of a potential delay. La Cave Spirituelle cannot be held responsible if your order cannot be delivered because of an incorrect address. In this case, the return costs will be added to your invoice. PO boxes are not taken into account for the deliveries.

Carriage and Responsibility : In accordance to the Art. 105 of the French Code de Commerce, all goods are carried at your cost, risk and peril. It is thus in your own interest to verify the contents of your package and to express your reservations if necessary at the time of delivery on the despatch note provided by the carrier and to inform La Cave Spirituelle by means of a registered letter or by telephone within 3 (three) days upon receipt of the package.

Returns Policy : As stated in article L. 121-16 of the Consumers' Code, France, you have the right to return goods, at your own cost, in good condition and in the original packaging with the original bill, within 7 (seven) days (including the day of delivery), to La Cave Spirituelle for exchange or refund. As a result, La Cave Spirituelle will reimburse the amount paid on the order or will give a credit note to the buyer within 30 (thirty) days at the most.

Data Confidentiality : In accordance to French law N° 78-17 dated 06 January 1978, originating from the French National Commission for Information Technology and Individual Liberties, relating to data-processing, files and individual liberties, you have the right to access, rectify and delete any personal data about yourself kept by La Cave Spirituelle.
La Cave Spirituelle guarantees that your personal details are only used by its staff to process your order. This information will under no circumstances be given to a third party without your agreement.
